By using the website(s) made available under http://dsapps.aizo.com/ (hereinafter “the Website” or “the Websites”) you are accepting these Terms of Use. If you do not agree with anything in these Terms of Use, you should not use the Websites.
The Websites are operated by aizo AG, Brandstrasse 33, CH/8952 Schlieren (hereinafter referred to as “aizo” or “We”, “Us”, etc.). You, as the user of the Websites, will be referred to hereinafter as “You” or the “User”.
Through the Website, You will find applications You can download and use (hereinafter referred to as “dSS Extensions” or “dS-Apps”). By downloading a dS-App You declare to be bound by these Website Terms of Use. Also, by downloading a dS-App You declare to be bound by the license terms applicable to the respective dS-App. Except where explicitly stated otherwise, the license applicable to the dS-Apps is the creative common share alike.
All intellectual property rights in relation to the Websites are reserved. Rights in dS-Apps are held by third party developers, and not by aizo. Use of other content on the Websites (i.e. other than dS-Apps), including but not limited to, images, diagrams, and texts, other than for the limited purpose of visiting the Websites, is not permitted without prior written consent from aizo.
The information contained on the Websites is for general informational purposes only. While aizo endeavours to keep the information up to date and correct, the Websites are provided “as is” and aizo does not make any representations nor warranties of any kind, whether express or implied, about the completeness, accuracy, reliability, suitability or availability for any purpose, with respect to the Websites or the information, products, services, or related content contained on the Websites. Nothing on the Websites should be taken to constitute professional advice or a formal recommendation. Should you rely on the information provided on the Websites you do so at your own risk.
To the extent permitted by applicable law, aizo excludes all liability for damages caused to you and/or to third parties. In no event will aizo be liable for damages caused by its auxiliary persons.
With respect to the dS-App You download, you may have contractual rights towards the third party having rights in the dS-Apps. aizo is not a party to that relationship.
aizo does not monitor or control dS-Apps uploaded on the Website. Developers uploading a dS-App are required to do upload source code versions, only. It is at Your charge to review and analyse the dS-App You have downloaded prior to using it. As the dS-App is available in source code form, this is possible to You. Where You do not have the skills required to analysing the dS-App, You hereby commit that You will take third party advice before using the dS-App.
Notwithstanding the above, aizo excludes all warranty and liability claims You may have against aizo from Your downloading and using a dS-App. The exclusion of warranty set out under Clause 2 as well as the exclusion of liability set out under Clause 3 shall apply in addition to this Clause 4.
aizo reserves the right to modify these Website Terms of Use at any time. aizo will strive to announce a change to the Website Terms of Use in advance. You agree to consult licensing information available on the Website regularly in order to learn from potential changes to these Terms of Use, or the license applicable to dS-Apps. If You continue using these Websites, in particular by downloading a dS-App, You will be bound by the then applicable Terms of Use.
Changes to these Website Terms of Use may involve changes to the rules under which You can download and use the dS-Apps available on the Website. In particular, aizo reserves the right to make download of certain or all dS-Apps subject to prior payment of fees.
Any of your use of the Websites shall be interpreted and governed by the laws of Switzerland.
